Approved Project Faces Legal Challenge, Leaving Spagó’s Future in Doubt

The approved Spago canopy may now face further review after a legal challenge by Lytham Voice.

Spago have today (Thursday 9th April) issued this statement:

‘We are extremely disappointed that Lytham Voice CIC have chosen to issue a legal challenge following the approval of our canopy.

‘After more than a decade of applications, revisions, and significant financial investment, we finally received approval through the proper planning process. This decision was made by elected representatives, following full consideration of the application.

‘This challenge is not about the merits of the proposal. It is based on alleged technicalities in how the decision was made — despite the fact that we followed every step of the process correctly and in good faith.

‘The reality of this action is simple: it places us back into uncertainty and forces us to make an impossible decision — either accept it, or spend tens of thousands of pounds once again defending something that has already been properly approved. For an independent business, that is an enormous and unnecessary burden.

‘It is also fair to ask: is this really what the community wants?

‘Lytham Voice CIC present themselves as representing the community — but we believe it is important that people understand what is being pursued in their name.

‘Has there been meaningful consultation with the wider community on this action?

‘Are people aware that time, energy, and community donations are being directed towards legal challenges of this nature?

‘Spagó has been part of Lytham for many years. We have invested heavily, supported local initiatives, employed local people, and worked hard to contribute positively.

‘To face continued challenges of this kind, after doing everything properly, is incredibly disheartening.

‘On a personal level, this ongoing situation has taken a significant toll. After years of investment — both financially and emotionally — it is becoming increasingly difficult to justify continuing under these conditions.

‘The honest truth is that, if this situation continues, this could be our last summer at Spagó.

‘Situations like this raise serious questions about the future. We cannot continue to operate under constant uncertainty.

‘We believe the community deserves clarity on how it is being represented and how funds are being used.

‘It is only right that people ask questions, seek transparency, and decide for themselves whether this reflects their views and how they wish their support to be used.

‘So we ask again: is this what the community wants?

‘And are they truly being represented?

‘We hope that common sense prevails and that this challenge is reconsidered, allowing us to move forward and continue contributing to Lytham in a positive way.’
